Summary Annual Report

Available for download is a copy of the Summary Annual Report for the KRISPY KREME DOUGHNUT CORPORATION WELFARE BENEFITS PLAN. This report is required by the Employee Retirement Income Security Act of 1974 (ERISA). It provides a summarized text version of a filing the Plan makes with the EBSA, an agency within the DOL, on an annual basis. Plan participants have a right to receive a paper version of the above-referenced document upon request. Where applicable, the Plan sponsor reserves the right to charge a reasonable fee to cover the cost of furnishing the document. Krispy Kreme is required to provide Krispy Kremers with Legal Notices concerning their rights and responsibilities under a benefits program on an annual basis. These Notices cover a variety of topics and may not apply to everyone.

Notice of Creditable Coverage (Medicare Part D)

The Legal Notices document includes a Medicare Part D Creditable Coverage Disclosure Notice which contains important information about Krispy Kreme Doughnut Corporation’s current prescription drug coverage and your options under Medicare’s prescription drug coverage (Medicare Part D). Please keep a copy of this notice for your records.

Krispy Kreme Doughnut Corporation has confirmed that prescription drug coverage offered under our Medical/prescription drug plan(s) is, on average for all plan participants, expected to pay out at least as much as standard Medicare prescription drug coverage pays and is therefore considered Creditable Coverage.

The Symetra (Mini) plan is not considered Creditable Coverage.

You are responsible for providing a copy of this Notice, electronically or in hard copy, to any of your dependents who are eligible for Medicare.

Children’s Health Insurance Program (CHIP)

One of the notices contained in the Legal Notices document informs eligible employees of their possible right to receive financial assistance through Medicaid and the Children’s Health Insurance Program (CHIP) to pay for premiums for health coverage under your employer’s plan, if such assistance is currently available in the states in which you reside.

The Children’s Health Insurance Program Reauthorization Act of 2009 (CHIPRA) was enacted on February 4, 2009, and reauthorized the federally-mandated State Children’s Health Insurance Program (SCHIP) which is partially funded under state law. CHIPRA not only imposes an annual notice requirement on employers who sponsor group health plans, it also requires plans to offer a 60-day “special enrollment” period (rather than the prior 30-day period under HIPAA) for employees and/or dependent children who either lose coverage under, or become eligible for group health premium assistance under, a Medicaid plan or a state CHIP plan.
